Podmínky užití služby

§1 Overview

  1. The use of all AdTaily services and its website is subject to the Terms of Service (TOS) published at: http://adtaily.com/tos. You agree that your use of the AdTaily service as a publisher and/or advertiser acknowledges that you have read this agreement, understand it, and agree to be bound by its terms and conditions. You should monitor the above adress for any changes in Adtaily TOS.

§2 Definitions

  1. AdTaily is an online advertising network, operated by AdTaily Sp. z o.o.
  2. Application is a web based computer software owned by AdTaily dedicated to buy, sell, manage and display ads
  3. Any person who registers a publisher account in AdTaily is a Publisher.
  4. Any person who buys ads through the Application is an Advertiser.
  5. The Website is any internet property owned by the Publisher.
  6. The Campaign is each purchase of advertisement display on the Publisher’s Website for a specified number of consecutive days.

§3 Publishers

  1. Publishers must have their own website setup in order to use the AdTaily service. AdTaily.com does not provide any blog, journal, or website hosting products or services. Publishers are responsible for all fees associated with their hosting maintenance and all other fees associated with their website.
  2. Publishers must first create account with AdTaily. Creating and maintaining of the Publisher account also means accepting the AdTaily TOS.
  3. Publishers who wish to sell ads through the Application must install the Application on his/her website.
  4. Publishers must create a profile within their AdTaily account for each Website they want to use AdTaily on. All information provided in the Website profile must be correct. Misleading and incorrect information in the Website profile might result in the Publisher account being closed and/or deleted.
  5. AdTaily does not take any responsibility for improper installation and/or use of the Application by the Publishers.
  6. Publishers are obliged to set the weekly display price of an ad on his/her Website in the Application.
  7. Publishers have the right to change the price at any moment in the Application. Changing the price will not affect any ad purchases that were done prior to the change being made.
  8. Publishers can switch ad moderation on for each website profile in the Application.
  9. If ad moderation has been turned on in the Application Publishers have the right to accept or deny the display of each ad on their Website . If the ad moderation is switched off, any purchased ad will be displayed immediately after the price is paid by the Advertiser. Leaving moderation off means that the publisher accepts any ad submitted by the advertiser.
  10. Publishers must prevent obstructing the display of any ads purchased (provided he/she accepted the display of an ad or left the moderation off, as stated in §3.9.
  11. Publishers are not allowed to uninstall the Application during any active campaign on his/her website. Such uninstallation can result in the Publisher account being closed and/or deleted and initiation of Paypal Dispute process.
  12. Publishers must ensure proper execution of the Application code during any active campaign. The publisher cannot prevent the code from being executed in the visitors browser, or otherwise reduce the visibility of the purchased ad.
  13. For every ad purchased on a Publisher’s website, AdTaily will initiate a direct Paypal transfer from the Advertiser’s to the Publisher’s Paypal account.
  14. Any act of misleading information, preventing Application code from executing, preventing displaying of the ad, preventing the website viewer from seeing the ad and any other act against the Advertiser’s or Adtaily’s business in relation to particular ad purchase can result in AdTaily initiating Paypal Dispute process and closing and/or deleting Publisher’s account.

§4 Advertisers

  1. Advertisers who wish to display an ad on a specific website with the AdTaily.com Widget must:
    • upload a picture which will be displayed on the website. Following formats are supported: JPG, PNG, flat GIF. The dimensions must be 125x125 pixels, the size must not exceed 200KB; or
    • create the ad design using ad creator in the Application
    • provide a URL where an ad will direct to;
    • set the amount of days he/she wishes the campaign to last;
    • agree to pay the price set by the Publisher through his/her PayPal account or credit card within specified period
  2. The advertiser confirms that she/he holds all copyright to the ad submitted to AdTaily.
  3. The advertiser grants AdTaily all copyright necessary to distribute, display and store the ad copy and graphics design.
  4. The display of an ad begins immediately or once it is accepted by the Publisher if the moderation is switched on for the particular website
  5. If a Publisher rejects an ad, the Advertiser will not be charged and the payment agreement will be canceled.
  6. Advertisers are not allowed to buy ads that spread racism, fascism or social discrimination of any sort. Advertisers are not allowed to buy ads with pornographic or pedophiliac content.
  7. AdTaily reserves the right to withhold any ad if it decides it to be improper or offensive.
  8. Any improper use of AdTaily, with special consideration but not limited to changing the ad link destination, copyright violation, changing the content of the destination page after the acceptance of the ad by the publisher will result in the campaign being stopped. No refund or return of credit will be made in such a case - the Advertiser will pay for the full length of the campaign regardless of the amount of days the campaign actually lasted.
  9. If any violations of the rules above are encountered, please notify AdTaily.com by e-mail at support@adtaily.com.

§5 AdTaily obligations and Limits of Liability

  1. Providing of the Application does not constitute any form of transfer of any intellectual property.
  2. The Application is provided in the SaaS (Software-as-a-Service) model.
  3. AdTaily reserves a right for maintenance breaks in service’s availability.
  4. Direct (meaning happening directly on the Publisher’s website) transactions (Ad purchases) within the Application are commission free.
  5. AdTaily does not take any responsibility for any ad displayed with the use of the Application.
  6. AdTaily does not take any responsibility for Publisher’s obligation to display the ad. However, AdTaily will initiate Paypal Dispute process whenever Publisher does not meet his obligations.

§6 Privacy Policy

  1. AdTaily.com does not share data provided by Publishers and Advertisers with any third parties. All data is used solely for the assurance of appropriately-functioning services offered by AdTaily.com.
  2. If Publisher agrees (by checking a relevant checkbox in the Application) to make his/her website statistics public, AdTaily.com may publish those statistics on the company’s homepage and/or the Application

§7 Changes to the Terms

  1. AdTaily.com reserves the right to add, delete or modify any part of the above Terms of Service, at any time, without further notice, and at its own discretion. You may always access a current version of the AdTaily.com Terms of Service at http://adtaily.com/tos/.
